What is personal injury law?
The Law Offices of Cochran, Kroll & Associates specialize in personal injury law. Our practice is devoted to representing individuals who are the victims of auto accidents, medical malpractice, work place or other injuries. Essentially, if a person has been involved in some kind of accident that causes a physical injury requiring compensation, we provide legal services.

If I have been injured and can’t work, how am I to pay for an attorney?
The majority of attorneys who practice personal injury law, including Cochran, Kroll & Associates, work under a contingency fee agreement. The agreement states that the attorney will only be paid a fee if a recovery is made.

What if there is no recovery?
There is no fee. The purpose of the contingency fee agreement is to provide access to justice. It would be totally unfair if an injured person was unable to seek compensation because he couldn’t afford an attorney.

What if you don’t want to retain a lawyer, but merely talk about a possible case?
No problem. Our firm provides a free consultation either on the telephone, over the internet or in person in our office, or if they are severely injured, in their home or hospital room.

There has been a lot of discussion about lawsuit abuse. Are we a society that just takes turns suing each other?
No. This is a myth created by the insurance industry. In our country, a jury makes an award to an injury victim after hearing all of the evidence. The award is designed to compensate the injury victim. One of our fundamental rights is a trial by jury, allowing fellow citizens to hear our case and make a decision. As a result, the hourly worker and the executive are treated the same regardless of income or status.

When can file a lawsuit?
Under the Michigan Statute of Limitations, the legislature has set deadlines for claimants to file complaints. Depending upon the nature of the cause of action, this may be from one to fifteen years after the incident. To protect the rights of our clients, the first thing we determine is the applicable period, and then make sure that the complaint is filed well before the expiration date.

Does Cochran, Kroll & Associates specialize in any type of case?
Yes, the majority of Terry Cochran’s practice is devoted to representing persons involved in serious motor vehicle accidents. Eileen Kroll, who in addition to being an attorney is also a registered nurse, specializes in medical malpractice cases.

How long does a Lawsuit take?
Some cases take longer than others, particularly medical malpractice cases. However, 18-24 months is not unusual.

Can my case settle out of court?
Yes. In fact, 95 percent of all cases at the Law Offices of Cochran, Kroll & Associates, P.C. result in out-of-court settlements before trial. However, most cases have to be placed into suit before the insurance company will take the claim seriously.

What are my responsibilities?
Above all else, honesty. If you do not tell your attorney everything, your attorney’s ability to help you will be compromised.

What is an interrogatory?
An interrogatory is a legal question that the Defendant asks you to answer in writing. Your answer will be under oath and must be accurate.

What is a deposition?
A deposition is a court proceeding that is conducted out-of-court and usually at the office of an attorney. The deposition is a sworn statement in the presence of a stenographer. The deposition follows answers to interrogatories and the length is dependent upon the complexity of the case. Your attorney will be with you throughout your deposition to make appropriate objections as necessary.
